From at least November 2013 to June 2016, Social-Lites Pty Ltd represented to consumers on our website at www.sociallites.com.au, and on YouTube, that our e-cigarette products:
In fact, when our e-cigarette products are used, the vapour produced for inhalation does contain carcinogens and toxic substances, including Acetaldehyde, Acetone, Acrolein and Formaldehyde. Those chemicals are carcinogens and toxic substances which are also found in tobacco cigarette smoke.
Following Federal Court proceedings taken by the Australian Competition and Consumer Commission (ACCC), the Court has found that the representations which we made on our website and on YouTube were false, misleading or deceptive in contravention of the Australian Consumer Law (ACL).
As part of its orders, the Court also restrained Social-Lites and its director Mr Lee O’Hare from engaging in similar conduct, imposed pecuniary penalties of $50,000 on Social-Lites and $10,000 on Mr O’Hare, and also required Social-Lites and Mr O’Hare to pay a contribution of $10,000 to the ACCC’s costs of the proceeding.
This corrective notice has been paid for and placed by Social-Lites Pty Ltd pursuant to an order of the Federal Court of Australia in an action commenced by the Australian Competition and Consumer Commission
